The primary duties include, but are not limited to:
- Oversee and manage case load from inception to closure;
- Provide availability/”open door” policy for paralegals/ staff to present questions on matters for managing attorney review and final approval;
- Conduct initial consultations of prospective clients;
- Conduct first in-person appointments to determine viability of claim/s and identity of employer, collect case information and relevant documents, and effectuate retention;
Manage case deadlines, including ensuring timely action in all cases assigned; - Work with managing attorney as the case develops and to determine the best litigation strategy;
- Review and assess matters to ascertain the likelihood of recovery, case value, pre-litigation or litigation strategy, etc.;
- Answer client questions and guide him or her through the employment dispute process;
- Maintain communication with client(s) and staff through the course of the claim and litigation. Maintain communication with client(s) and staff through the course of the claim. This includes meeting with clients (in-person, over the phone and/or in court) to initiate contact, answer questions, and discuss case updates, settlement, and additional claims; etc.;
- Gather evidence;
- Take depositions of the Applicant, employers/supervisors, and other parties;
- Conduct discovery;
- Propound/Respond to discovery;
- Perform legal research;
- Negotiate settlements on behalf of the claimant;
- Remain current with developments in the law;
- Draft Right to Sue Letters, pleadings, findings of fact, complaints, demands, motions, briefs, opinions and other legal documents;
- Represent the interests of the claimant at hearings, trials, depositions, oral arguments, mediations, arbitrations and other proceedings;
Litigate cases in court; and - Other duties as assigned by Management.
Competencies/Skills:
- Active, acute knowledge of labor laws and procedures;
- Active, acute knowledge of legal experts;
- Active, acute knowledge of mediators, judges, arbitrators;
- Active knowledge and ability to settle pre-litigation/litigation cases for full value;
- Ability to handle large caseloads and juggle multiple priorities and deadlines;
- Ability to meet with "problematic" clients;
- Ability to identify "high value" cases early on and coordinate with paralegals;
- Ability to identify matters that are uneconomical to litigate;
- Active knowledge of statute deadlines;
- Ability to actively investigate a case;
- Knowledge of government claim timelines/deadlines/statutes;
- Knowledge of worker's comp and personal injury timelines/deadlines/statutes for cross-over cases; and
- Computer skills such as MS Office, and on-line research tools such as LEXIS-NEXIS, West Law.
- This position requires physical activity including but not limited to bending, stooping, repetitive motion, and lifting of up to 20 pounds. This position may also require sitting for prolonged periods of time.
Qualifications:
- Juris Doctorate degree and current good standing with CA State bar is required;
- Minimum 1-3 years’ experience working in a law firm Employment department;
- Must possess strong interpersonal and social skills;
- Demonstrates and takes initiative and has compassion for those requiring our services;
- Excellent written and verbal communication skills;
- Must have good familiarity with Employment Law and Workers’ Compensation terminology; and
- Bilingual, fluent in English/Spanish preferred.
