In this case, a dump truck driver parked on a hill and then failed to set the parking brake correctly. After its driver got out, the unmanned dump truck rolled down a hill and into Hollywood Boulevard where it collided with a Los Angeles County Metropolitan Transportation Authority (LACMTA) bus.

At first blush, it was unclear how the bus driver and her employer, the LACMTA, could have been at fault. But, through a bus injury lawsuit against them and the discovery process we are able to find out that the driver was a trainee and her supervising bus driver was not paying attention.

Additionally, on the day of the accident, it was raining and the bus was going too fast for conditions while traveling in the unfavorable lane of travel, all of which led to the bus being in the wrong place at the wrong time. Finally, we were able to procure LACMTA training manuals to show that the bus driver was not trained correctly.

All of this led to one conclusion, that the bus driver’s employer did not train and supervise her appropriately. While the dump truck held much of the fault, because California is a comparative fault state, we were able to prove that LACMTA was partially at fault, which led to a much more favorable settlement for our client.
