Have you been injured in a Bus Accident?

Proving negligence against bus drivers and their employers is often a complex and winding road. Few bus injury accidents are open and shut cases.

In our 30 years of experience, it seems nearly every bus accident injury case that we’ve worked on we’ve had to file a bus accident lawsuit to get the justice and compensation our injured clients deserved.

That is why when you’re pursuing a negligence claim against a bus driver and their employer, it is necessary to engage a bus accident lawyer to champion the fight for you. Without the key insight and knowledge of a bus accident lawyer, you are severely disadvantaged as the bus driver and employer will certainly have top-notch, aggressive lawyers defending them. Moreover, in so many of these cases, the bus is owned and operated by a public entity, which adds another layer of complexity as you have to adhere to the strict rules and deadlines of the government torts claim act.

Bus Accident Lawsuit

Here’s an example of how the bus accident lawyers at The Dominguez Firm were able resolve a very difficult bus injury lawsuit in our client’s favor.

In this case, a dump truck driver parked on a hill and then failed to set the parking brake correctly. After its driver got out, the unmanned dump truck rolled down a hill and into Hollywood Boulevard where it collided with a Los Angeles County Metropolitan Transportation Authority (LACMTA) bus.

At first blush, it was unclear how the bus driver and her employer, the LACMTA, could have been at fault. But, through a bus injury lawsuit against them and the discovery process we are able to find out that the driver was a trainee and her supervising bus driver was not paying attention.

Additionally, on the day of the accident, it was raining and the bus was going too fast for conditions while traveling in the unfavorable lane of travel, all of which led to the bus being in the wrong place at the wrong time. Finally, we were able to procure LACMTA training manuals to show that the bus driver was not trained correctly.

All of this led to one conclusion, that the bus driver’s employer did not train and supervise her appropriately. While the dump truck held much of the fault, because California is a comparative fault state, we were able to prove that LACMTA was partially at fault, which led to a much more favorable settlement for our client.
